My fiance ran into the back of some lady's car when we were on our way to the store. Since it was my car I gave my insurance information becuase I assumed he wouldnt be able to use his since it was MY car. I lied and said that I was driving. Was this the correct thing to do? Would his insurance have covered my and the lady's repairs? Would I have gotten in any trouble for letting him drive my car even though he is not on my insurance to do so?

No one was injured in the accident. It was just a "fender bender" and we were going like maybe 10 MPH when it happened. We didnt call the police so there is no police report. I annonomously called my insurnace company and they said no matter who was driving since it was my car, my insurance has to pay for both cars and my insurance will go up. Now if I say that i was mistaken, he was driving, not me, then both of our insurances will go up and will stay on our records for 7 years. But the points will go to him and not me. I have a clean driving record and that pisses me off but Im thinking its probably best just to take the friggin points and keep my mouth shut. I have a boys name so maybe the woman will just think that I gave her his information or maybe the whole driver situation wont be questioned. Yes, he is going to pay my deductable and I should probably make him pay the difference in my monthly insurance bill as well. Gosh, I hope it doesnt go up too much!

Do you think I should call my insurance company and tell them that I wasnt really the one who was driving or do you think that would make things worse? Because then I would be telling on myself for lying and they could try to take me to court or cancel my policy. No check has been written YET for the claim. I was recorded saying that i was driving by the lady's insurance company. Im scared now. AHHHHHH

if hes not insured to drive your car then he shouldn't have been driving it if you would have been pulled over he would have had his licence taking away and the car impounded because he was driving without insurance.

lots of problems. Not written in your note but I assume you had it investigated by police, and someone was cited for following too closly?
1. you broke the law, insurance fraud and obstructing a police officer by lying.
2 his insurance would have covered him
3 your insurance will go up along with your points on your DL

Yes, his insurance would have covered him driving anothers vehicle.
YOu gave him permission though, to drive yours.
But they do have it where if the person driving has insurance it goes on them, their points, their responcibility.

First of all, lying about driving is never the "correct" thing to do. And I don't think he would get in trouble for driving your car. My bf drives my car all the time. Why not just tell the truth? I'm sure something could have been figure out.

Your car, your insurance. Now your insurance should have coverage for "alternate drivers" So the only differance would be that if you stated that he was driving, he would be liable for the possibility for points on his license. As for your insurance rates, it really doesn't matter who was driving. your rate could increase even if you stated that he was driving. however, that rate could be lowered if you had a signed affidavid stateing that he would never drive your car again. Bottem line. You should have let him take resposibility for being behind the wheel.

well, aside from the lying about who was driving (cuz that could come back to bite you in the ass if your ins. co. finds out you lied, they can deny to cover the accident/damage and even cancel your policy for falsifying the claim), on your insurance policy do you have uninsured driver coverage?

There was no point (there never is) in lying about who was driving. Now your driving record will take the hit with regard to points, your insurance rates will likely be affected, you had to have involved the victim of the accident in this deception and now there are three people lying to cover up something that never needed to be covered in the first place. Saying that you was driving was the wrong thing to say. Your insurance would have covered him as the driver. You maybe listed as the primary driver but they do cover temporary drivers such as your boyfriend, even if he was driving alone. His insurance covers his car. Your insurance covers your car.

Yes you can get in to trouble. By lying and insurance company finds out, this gives them an out and do not have to cover anything. Because you falsified the report. So your car and the ladies car would then be YOUR responsibility. As it is, the police ticket fines and points will go against your drivers license. You are now legally responsible for his mistake.

A few things ... is he excluded on your insurance? If not you shouldn't get in trouble for letting him use/drive your car, but his insurance should have been used since he was driving and at fault. Now your rates will potentially go up due to the accident and the fact that you actually had the nerve to use the insurance you pay for (sarcasm intended) ... Hope he helps with the difference.
