My brother had a car accident last week. He ran off the road to avoid hitting 2 dogs. It blew out two tires, there were no dents in his car. Though the insurance company has totaled the car.

He bought the car used and was still making payments. The insurance company is going to pay $2300, though the pay off on the car is $8000 it is a 2000 Neon.

The car lot is a buy here pay here place and they do not carry gap insurance on their cars. That leaves him to pay the remaining $4700 and he has no car and no money for another car.

What if anything can anyone suggest that he do about this situation?

Thank you everyone for responding. My brother has only had the car for 6 months, he is a single father and has no money to buy or even put as a down payment on another car. I have never seen or heard of a car being totaled without having any body damage. I have heard that a car is considered a total lost if the frame is broken or damaged beyond the book value price of the car. I am thinking the car was like that when he bought it because it has had an oil leak that the car lot repair guy couldn't seem to fix and a cracking sound when turning. There is a big difference between $2300 and $8000. Thank you all, you have offered good advice.

My fiance ran into the back of some lady's car when we were on our way to the store. Since it was my car I gave my insurance information becuase I assumed he wouldnt be able to use his since it was MY car. I lied and said that I was driving. Was this the correct thing to do? Would his insurance have covered my and the lady's repairs? Would I have gotten in any trouble for letting him drive my car even though he is not on my insurance to do so?

No one was injured in the accident. It was just a "fender bender" and we were going like maybe 10 MPH when it happened. We didnt call the police so there is no police report. I annonomously called my insurnace company and they said no matter who was driving since it was my car, my insurance has to pay for both cars and my insurance will go up. Now if I say that i was mistaken, he was driving, not me, then both of our insurances will go up and will stay on our records for 7 years. But the points will go to him and not me. I have a clean driving record and that pisses me off but Im thinking its probably best just to take the friggin points and keep my mouth shut. I have a boys name so maybe the woman will just think that I gave her his information or maybe the whole driver situation wont be questioned. Yes, he is going to pay my deductable and I should probably make him pay the difference in my monthly insurance bill as well. Gosh, I hope it doesnt go up too much!

Do you think I should call my insurance company and tell them that I wasnt really the one who was driving or do you think that would make things worse? Because then I would be telling on myself for lying and they could try to take me to court or cancel my policy. No check has been written YET for the claim. I was recorded saying that i was driving by the lady's insurance company. Im scared now. AHHHHHH

How much will your insurance go up on average if you just totaled a car. About a 5,000 dollar used car, my first wreck, ticket, or any traffic violation. And is the insurance agency the only one who would have a record of it if you didnt file a police report? Therefore meaning if I switched insurance agencies they would not know it happened?

I was doing an errand for work & was hit by a uninsured driver. He told the police officer he is just visiting from California. He gave the officer his insurance information which was a lie. I also had only PIP insurance on my car. I don't have transportation now cause my car is totaled. What can I do to recover some cost so that I can buy a used car?

Hey guys,

I recently purchased a used car and financed through the "credit union". Unfortually I got stuck with a :lemon" car and the car currently is not operable. At the moment It is currently insured with my insurance company and my credit union is saying that the car must be insured otherwise I will be FINED $700. Why should I have to pay for insurance for a car that Im not driving? Is there anyway I can bypass this by going to the DMV by anychance? Im still willing to pay off my loan with the credit union, but I just dont understand why I have to pay for insurance for a car Im not using!

A neighbor just called to tell me that a car took out my mail box and is sitting in the ditch in front of my house.

I have, well I guess HAD, one of those $500 security mail boxes to keep my ex from messing with my mail.

Will their car insurance have to pay to replace it?

I know my home owners insurance would cover it, but it would be the same as my deductable.

The car is no longer there. I hope they reported it to the police.

Update: January 23, 2008.
Just called the County Seriff's office. There WAS a deputy at the scene, so there WILL be a report... after he finished the next accident he is on his way to. That 8 inches of snow we got yesterday has left a lot of slick spots around the county. The biggest pain about this will be that I won't be able to put in a new box until Spring. And our little podunk post office is only open from 9 to 11 and 1 to 3, Monday through Friday, so I'll have to take off work in the middle of the day to drive the ten miles to get my mail for the rest of the Winter. Big UGGGHHH!
